Please review the following terms of use ("Agreement"), which govern your use of hombresadventues.com (Website), the purchasing of our services (the "Services") offered on the Site, and while participating in our events and for participation in our groups, social media pages, adventures and events. Your use of the Site and/or registration for any Services will constitute your agreement to comply with the terms of this Agreement. If you cannot agree to and comply with this Agreement and its requirements, please do not use the Services and exit the Site.
Additional Terms and Conditions
In addition to Terms and Conditions, herein, you are acknowledging that you are aware of the Cancellation policy and the Privacy policy which are accessible by way of the links provided in this paragraph and through our Website. Your consent to the Terms and Conditions herein, indicates that you have also reviewed, and you consent to the terms of the Privacy and the Returns policies. Your use of Website indicates that you agree to the Terms and Conditions herein.
Changes to Agreement and Additional Rules of Usage
We may amend or update the Terms and Conditions herein, at any time and without notice. The date of the most recent revision will appear on this page. Continued access to the Site and use of the Services by you will constitute your acceptance of any changes or revisions to the Agreement. You should visit this page and note updates to the Terms and Conditions.
Suspension or Termination of Your Use
Your failure to follow the terms of this Agreement may result in the restriction, suspension or termination of your access to the Website or to the products or services, without notice. In addition, Hombres may seek other legal remedies.
Ownership of the Site and Site Information
The Site is expressly owned and operated by a company operated in the Province of Ontario, Canada and referred to, henceforth as "Hombres Adventures" or "Hombres" . Unless otherwise noted, the design and content features on the Site, including information and other materials, illustrations, product layout and design, icons, navigational buttons, images, artwork, graphics, photography, text, data, audio sound, software and the like, as well as the selection, assembly and arrangement thereof (the "Site Information"), are owned by Hombres or licensed to Hombres. The Website, as a whole and in part, is protected by copyright, trademark, service mark, trade name, and other intellectual property and other proprietary rights, and all other applicable rights are reserved.
Site Information is Provided "As Is"
Site Information is provided “as is” with all faults. You use the Site Information, as authorized herein, at your own risk. Site Information may contain errors, omissions, or typographical errors or may be out of date. The Site may change, delete or update any Site Information at any time and without prior notice.
Use of the Service By You
You may view and use the Site Information only for your personal information and for shopping and ordering on the Site. Except as set forth in this Agreement, the Site does not grant to you any right to use, reproduce, copy, modify, transfer, display, publish, sell, license, create derivative works, publicly perform, or distribute by any means, method or process any Site Information. Your right to use the Site and the Services is personal to you. You may not authorize others to use the Site and the Services, and you are responsible for all use of the Site and the Services by you and by those you allow to use, or provide access to, the Site and the Services. You agree to use the Site and the Services only for lawful purposes and you acknowledge that your failure to do so may subject you to civil and criminal liability.
Non-Commercial Use Only
The Site is for the personal use of individuals only and may not be used in connection with any commercial endeavors. Organizations, companies and/or businesses may not use the Services, the Site Information or the Site for any purpose without written consent of or agreement with Hombres. You agree not to make use of Site Information by publication, re-transmission, distribution, performance, caching, or otherwise, except as permitted by law or as expressly permitted in writing by this Agreement or Hombres. Illegal and/or unauthorized uses of the Site, including efforts to collect usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email and unauthorized framing of or linking to the Site, will be duly investigated and legal action will be taken, including without limitation, regulatory, civil, criminal and injunctive redress.
Eligibility to Use the Site and the Services
The Site and the Services are not intended for users under the age of 21. To register for any Services offered on the Site, you must be 21 years of age or older. Hombres does not knowingly collect personally identifiable information from users under the age of 21 . Persons under the age of 21 are prohibited from using the Site. If a person under the age of 21 submits information through any part of the Site, and Hombres becomes aware that the person submitting the information is under the age of 21, we will delete this information as soon as possible and prohibit further access to that person.
Disclaimer or Warranty and Limitation of Liability
You acknowledge that you are using the site and the services at your own risk. The site, the site information and the services are provided "as is," and to the full extent permitted by applicable law, Hombres, its affiliates and its third party service providers hereby expressly disclaim any and all warranties, express and implied, including, without limitation, any warranties of accuracy, completeness or reliability, title, noninfringement, merchantability or fitness for a particular purpose, or any other warranty, condition,
guarantee or representation, whether oral, in writing or in electronic form. Hombres, its affiliates, and its third party service providers do not represent or warrant that access to the site and its services will be uninterrupted or that there will be no failures, errors or omissions, or loss or security breach of transmitted information, or that no viruses will be transmitted through access to or use of Hombresadventures.com
Hombres its affiliates and its third party service providers shall not be liable to you or any third parties for any direct, indirect, special, consequential or punitive damages arising out of this agreement, the provision of services hereunder, the sale or purchase of any merchandise ordered through the site, your access to or inability to access the site, site information, or services, including for viruses alleged to have been obtained from the services, your use of or reliance on the services, the site information or materials available through third party sites linked to the site, regardless of the type of claim or the nature of the cause of action, even if advised of the possibility of such damages.
You hereby agree to release Hombres, its affiliates and third-party service providers, and each of their respective directors, officers, employees, and agents from any and all claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed ("claims"), arising out of or in any way connected with your use of this site and its services. If you are a California resident, you waive California civil code section 1542, which states, in part: a general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor.
There will be further terms and conditions that will be listed in the itinerary of an adventure that you are purchasing. Those terms and conditions shall be deemed to be amending the Terms and Conditions of the Agreement. In the event that said amendments are conflicting the Terms and Conditions of the Agreement, they shall take precedent over the Terms and Conditions of the Agreement.
Terms and Conditions set by the hotel, transportation services, meal venues and activity venues are independent of Hombres and are enforceable in respect to same.
Electronic Communications
When you visit the Site or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by email or by posting notices on the Site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
Jurisdiction and Governing Law
Hombres makes no representation that the Site Information, the Services or products offered through the Site are appropriate, available or legal in any particular location. Those who choose to access the Site Information, the Services and products offered through the Site do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable. You agree that any and all purchases of products and services from Hombres, whether chargeable provided at no cost and whether paid or otherwise shall be deemed to have a point of sale in the Province of Ontario, Canada. You agree that this Agreement, for all purposes, shall be governed and construed in accordance with the laws of the Province of Ontario and any action based on or alleging a breach of this Agreement must be brought in a provincial court in the Province of Ontario. In addition, both parties agree to submit to the exclusive personal jurisdiction and venue of such courts.
Our Events and Activities
Changes to Itinerary
Hombres reserves the right to alter the itinerary and /or items included in our adventure package as provided herein:
- To accommodate any health and safety concerns, if they become known to us.
- To rectify logistical issues with regard to activity, eating and accommodation venues or transportation to or from venues.
- To better accommodate the number of participants.
- To enhance the adventure experience.
If we make such changes, we will inform our adventure purchasers of said changes made to the adventure to which they are a purchaser, on the following:
- Changes made prior to the deposit deadline will be advised before the deposit deadline
- Changes made after the deposit deadline but prior to the final payment deadline will be advised prior to the final payment deadline.
-Changes made after the final payment deadline but prior to the refunded cancellation deadline will be advised prior to the final payment deadline.
- Changes made after the refunded cancellation deadline but prior to the adventure will be advised prior to the adventure.
- Changes made during the adventure will be advised as soon as possible.
In any event, changes made to the itinerary shall be made with care as to not inconvenience our participants and to enhance their enjoyment, as much as is possible. Changes will maintain or upgrade the quality and class of the accommodation venue, meal experience or replacement activity.
Notwithstanding the above, Hombres reserves the right to cancel an adventure, in the event of exigent circumstances or in the event of insufficient participant number. In such event, Hombres will advise the purchasers as soon as possible. Hombres shall reimburse participants of a cancelled event within 14 days of its cancellation. Hombres shall not be liable for damages to purchasers of a canceled adventure including but not limited to the cancellation of travel arrangements.
Changes to Itinerary Price
Our product and services prices, deposit requirement, and payment schedule are all subject to change. The price, payment and payment schedule on which you are entitled to rely and to which you are committed are those advertised on our order page, at the time at which you place and pay your deposit. If there is an information conflict in these amounts and payment schedule between our advertisements, other website pages and the order page, the order page will be deemed to be the final and determinant amounts.
Payment Schedule
Your deposit is required 45 days prior to your Adventure. Late registration payment will be accepted until 30 days prior to the Adventure, with a $200 late fee. Deposit and late fee are refundable up to 30 days prior to the Adventure (less $50 admin fee). Within 30 days of your Adventure, the deposit and late fee, (if paid), are not refundable.
Balance of your Adventure fee is due 30 days prior to your Adventure. If payment is not made as of the deadline, your registration will be cancelled. A refund will be made in accordance to our terms, herein.
Additional Charges
You may incur additional fees on your adventure for items that are not included and were not paid to Hombres as part of your adventure package:
-You may acquire services or products from the hotel. The hotel will apply those charges for said items to your room charge. You will be required to settle that account, as per the hotel policy.
- you may purchase additional items at meal venues, activity venues, elsewhere while you are participating in an Hombre activity or when you are outside of an Hombre activity. It is your responsibility to complete payment for any and all such charges. You may invite your companion to attend any of the activities that permit such participation. If you companion attends, she is deemed to have been invited by you. You are responsible for the fee associated with the companion attendance at that activity. Companion fees are listed on the itinerary. All additional charges incurred by you, must be paid prior to midnight of the last night of the adventure. Charges that remain unpaid shall be transferred to the hotel and added to your account. The hotel will apply a service charge to said transfer.
If you choose to absent from any activity or meal, you will not be entitled and will not receive a refund for such absence. If you are unable to attend a meal, we may or may not be able to accommodate your meal requirement. We take some care to make available a variety of meal items that will accommodate most participants. We cannot make arrangements for special dietary restrictions or requirements.
Safety and legal requirements
It is your responsibility to know and follow the laws of the land in the adventure venue. We do not provide legal advice, other than to explicitly advise you to keep to the law of the land. We do not permit the use, possession or transfer of illegal items and substances by our participants. If we learn of such activity, you will be barred from participating in our events. We will remove any participant that engages in non-consensual intimate acts with a companion. We will prevent participation of a purchaser who is intoxicated or is unable to control his behavior. There will be no compensation provided to a purchaser, in such circumstances.
We provide ample options for each participant to choose a companion and engage with a companion. However, we do not guarantee such engagement or its level of satisfaction.
Code of Conduct
Like any good time, an Hombre Adventure requires some ground rules. These rules are:
1. What happens on an Hombre Adventure stays on an Hombre Adventure.
2. The "Bro" code is in force. Do not cut into the action of a Bro.
3. No illegal conduct of any kind- No drugs, No illegal liaisons.
4. If you are inebriated and misbehave, you will not be permitted to attend an activity.
5. No means No. If a woman is not interested in you, move on. There will be 3 others who will jump at the chance to be with you.
6. The women care about their health and safety. However, we encourage all participants to practice safe sex. Once again-what happens on an Hombre Adventure, must not come home with you.
Ownership of information and disclosure
Hombresadventures.com is hosted for Use in the United States
The Site is hosted in the United States and is intended for users located in Canada and in the United States. If you are a user of the Site, not residing in Canada or in the United States, by visiting the Site, using its Services and/or providing us with any Content, you agree to comply with all applicable laws governing the Site, its Services, online conduct and acceptable Content. You further agree to comply with all applicable laws regarding the transmission of data exported from the United States or the country in which you reside
Trademark Notice
Hombres Adventures and the Site names, logos, and other identifying marks are the property of Hombres. Other featured words or symbols, used to identify the source of merchandise or services, may be the trademarks of their respective owners.
